Anthropic Faces Class-Action Lawsuit Over Claude Usage Limits

A recent lawsuit has been filed against Anthropic, the developer of the artificial intelligence chatbot Claude, by a disgruntled customer who alleges that the company's Claude Max subscriptions do not deliver the promised level of service. This legal action, spearheaded by Karl Kahn, a resident of Washington, D.C., contends that the actual usage limits for the Max 5x and Max 20x plans fall considerably short of what Anthropic advertises across its various platforms.

Kahn's complaint, detailed by Engadget and the Wall Street Journal, seeks to achieve class-action status, which could potentially broaden the scope of the lawsuit to include all U.S. subscribers who purchased a Max subscription since their introduction last year. Kahn’s personal experience is central to the complaint; he claims that after upgrading to the Max 20x plan in April, he still encountered weekly usage caps far sooner than expected, with a single five-hour period consuming a substantial 15% of his allocated weekly usage. Anthropic has, to date, refrained from commenting on the ongoing litigation.

This case underscores the inherent challenges in defining and implementing clear usage policies for AI services, particularly those that are compute-intensive. Large language models like Claude operate on "tokens," which are units representing the processed inputs and generated outputs. The cost and consumption of these tokens can fluctuate dramatically based on the complexity of user prompts and attachments, making it difficult to apply a straightforward, software-style subscription model. Anthropic previously imposed weekly limits on Claude Code in July, citing issues with some customers running the tool continuously, which further illustrates the difficulties in managing resource allocation for advanced AI tools.

The legal proceedings against Anthropic serve as a crucial reminder of the importance of transparency and accuracy in advertising, especially within the rapidly evolving artificial intelligence sector.
